This is an appeal from a revocation of probation. In October, 1970, the appellant plead guilty to a charge of possession of marihuana. He was sentenced to five years' imprisonment, but the court suspended the imposition of sentence and placed him on probation for a five-year period. In February, 1973, the State filed a motion to revoke, on which a hearing was held on March 1, 1973. At the hearing, the State proved that appellant had committed the offense of burglary in December 1972, in violation of the condition of his probation that he commit no offense against the laws. However, the court at that time refrained from immediately revoking appellant's probation, apparently because he was preparing to undergo treatment with the United States Public Health Service under the Narcotic Addict Rehabilitation Act, 42 U.S.C. Sec. 3413. On June 2, 1973, the appellant was again arrested, and on June 4, 1973, the court revoked his probation for the violation shown at the March 1, 1973, hearing.
